Hi, Raina,
Thanks for visiting our site. I hope that this might help you. Some of your questions depend upon which state you are located in. Here in Pennsylvania, either would work out if the right argument is made to your Judge. Can you tell me where you are located? I also think that you need to look at your first order and make sure that the Judge did not order some sort of rehab or tasks that your sister had to accomplish before she was to have custody returned. What is your current schedule? Do you have primary and she has some visitation, so Mother can see her child? Is this supervised visitation? I would recommend that as an interim step until some progress is made on her maturation or solving some of her problems that you feel make her an inappropriate parent. Whatever that is, and you still feel strongly that she has done nothing to make herself a better parent, you should get an authority to create some testimony to present to the court. If it’s a drug problem, you might recommend that she undergo rehab before she sees her daughter without supervision. What is her problem, basically? I think there are some guidelines that your court may have that will tell the Judge what is your sister’s problem and how she can make herself more likely to receive more time with her child. What you are doing is really wonderful because it is a big responsibility to take care of a child. When is your hearing with your Judge? Please write back and we can “talk” some more. My name is Raina Seay. I have primary custody of my 5 year old niece after my younger sister was unable to give her a stable home. We have a court hearing coming up and I believe the judge will give custody back to my sister even though she is not stable. I can either become a second parent for my niece whose father is deceased or to have some monitor my sister and my niece if she gets her back
